Terms & Conditions

1. Introduction

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Rider", or "Driver") and SafariBid Technologies Ltd ("SafariBid", "we", "us").

By downloading, installing, or using the SafariBid application or website, you agree to comply with and be bound by these Terms. If you do not agree, you may not use our Services.

2. Nature of Services

Platform, Not a Transporter

SafariBid is a technology platform that connects users looking for transport/delivery services with independent third-party providers (Drivers).SafariBid does not provide transportation or logistics services, nor does it function as a taxi company or carrier.The contract for transportation is directly between the Rider and the Driver.

3. User Accounts

  • Eligibility: You must be at least 18 years of age to create an account.
  • Accuracy: You agree to provide accurate, current, and complete information during registration.
  • Security: You are responsible for maintaining the confidentiality of your account password. You are liable for all activities that occur under your account.

4. The Bidding Model & Pricing

Unlike traditional ride-hailing apps, SafariBid allows price negotiation.

Negotiation

The "Recommended Fare" displayed is an estimate. Riders may offer a lower or higher price. Drivers may accept, reject, or counter-offer.

Binding Agreement

Once a Rider accepts a Driver's bid (or vice versa), a binding contract is formed at that specific price. Neither party may demand a change in price upon arrival unless the destination changes significantly.

5. Payments & Fees

  • Rider Payment: Riders may pay via Cash, Mobile Money (M-Pesa), or Card. Riders are responsible for the full fare agreed upon.
  • Driver Commission: Drivers agree to pay SafariBid a service fee (Commission) for every completed trip. This is deducted from the Driver's in-app wallet.
  • Refunds: Refunds for cancelled trips are processed to the in-app wallet. Cash payments generally cannot be refunded by SafariBid once the trip is complete.

6. Delivery Specific Terms

Users utilizing the "Delivery" or "Logistics" service agree to the following:

  • Prohibited Items: You may not send illegal drugs, firearms, stolen goods, or hazardous materials.
  • Packaging: The Sender is responsible for ensuring items are securely packaged. SafariBid is not liable for damage caused by poor packaging.
  • Receiver Availability: If the receiver is unavailable, the package may be returned to the sender at the sender's expense.

7. User Conduct

We enforce a zero-tolerance policy regarding:

🚫 Physical or Verbal Abuse
🚫 Sexual Harassment
🚫 Fraud or Theft
🚫 Discrimination

Discrimination against any Rider or Driver based on race, nationality, religion, gender, gender identity, physical disability, or age is strictly prohibited. Violation of this policy will result in immediate permanent suspension from the SafariBid platform.

8. Limitation of Liability

"As Is" Service: The Services are provided "as is" and "as available." SafariBid disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms.

Indirect Damages: SafariBid shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the services.

Third-Party Services: SafariBid makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the third-party providers (Drivers) or that the services will be uninterrupted or error-free.

9. Termination

SafariBid may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason, including but not limited to:

  • Violation of these Terms or Community Guidelines.
  • A consistent rating below the minimum threshold (for Drivers).
  • Fraudulent payment activity.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any dispute arising from these Terms shall be resolved through arbitration in Nairobi, Kenya.
